Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Jacobs Entertainment LLC ("Company," "we," "us," or "our") concerning your access to and use of the Queztions mobile application (the "App").

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree to these Terms, do not access or use the App.

Acceptance of Terms

By creating an account or using the App, you represent that:

• You are at least 13 years of age

• You have the legal capacity to enter into these Terms

• You will comply with these Terms and all applicable laws

• All information you provide is accurate and current

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App

• Updating the "Last Updated" date

• Sending an in-app notification or email (when applicable)

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App.

License to Use the App

Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device(s)

• Access and use the App for personal, non-commercial purposes

License Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App

• Reverse engineer, decompile, or disassemble the App

• Remove, alter, or obscure any copyright or trademark notices

• Rent, lease, lend, sell, or sublicense the App

• Use the App for any commercial purpose without our written consent

• Use the App in any way that violates applicable laws or regulations

• Use automated systems (bots) to access or interact with the App

• Attempt to gain unauthorized access to any part of the App

• Interfere with or disrupt the App's functionality or servers

• Collect or harvest any user information from the App

• Use the App to transmit viruses, malware, or harmful code

User Accounts

Account Creation

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information

• Maintain and update your information to keep it accurate

• Maintain the security of your account credentials

• Accept responsibility for all activities under your account

• Notify us immediately of any unauthorized use

Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms

• You engage in fraudulent or illegal activity

• You abuse or harass other users

• You use automated tools or bots

• We suspect unauthorized account access

• We determine termination is necessary for business or legal reasons

You may delete your account at any time through the App settings or by contacting us at queztionsllc@gmail.com.

User Conduct

Acceptable Use

You agree to use the App in a manner that is:

• Respectful to other users

• Compliant with all applicable laws

• Consistent with the intended purpose of the App

• Free from abusive, harassing, or offensive behavior

Prohibited Conduct

You must NOT:

• Harass, threaten, or intimidate other users

• Use offensive, vulgar, or discriminatory language

• Impersonate any person or entity

• Post or share inappropriate content

• Spam or send unsolicited messages

• Manipulate quiz results or game mechanics (cheating)

• Share accounts or allow others to use your account

• Exploit bugs or vulnerabilities in the App

• Use the App to promote other services or products

• Engage in any activity that harms the App or its users

Quiz Content and Intellectual Property

Our Content

All content in the App, including but not limited to:

• Quiz questions and answers

• Text, graphics, images, and logos

• Software code and functionality

• Audio, video, and multimedia content

• User interface design and layout

• Trademarks and branding

is owned by or licensed to Jacobs Entertainment LLC and is protected by copyright, trademark, and other intellectual property laws.

User-Generated Content

If you submit content to the App (such as custom quiz questions, comments, or feedback), you grant us a worldwide, non-exclusive, royalty-free, perpetual license to:

• Use, reproduce, modify, and display your content

• Incorporate your content into the App

• Create derivative works based on your content

• Distribute and sublicense your content

You represent that:

• You own or have rights to the content you submit

• Your content does not infringe on any third-party rights

• Your content does not violate any laws or these Terms

Reporting Infringement

Include:

• Description of the copyrighted work

• Location of the infringing content in the App

• Your contact information

• A statement of good faith belief

• A statement that the information is accurate

• Your physical or electronic signature

In-App Purchases and Virtual Currency

Coins and Virtual Items

The App may offer virtual currency ("Coins") and virtual items that can be purchased with real money or earned through gameplay.

Important:

• Coins and virtual items have no real-world value

• They cannot be exchanged for cash or legal tender

• They are non-transferable and non-refundable (except as required by law)

• We may modify, suspend, or discontinue virtual items at any time

Purchases

All purchases are:

• Processed through Apple App Store or Google Play Store

• Subject to the respective store's terms and refund policies

• Final and non-refundable except as required by applicable law

• Made in the currency specified at the time of purchase

You are responsible for:

• All charges incurred under your account

• Unauthorized purchases made on your account (including by minors)

• Ensuring you have authorization to use any payment method

Price Changes

We reserve the right to change prices for Coins and virtual items at any time without notice.

Free App and Advertising

Free Service

Queztions is provided free of charge. We may display advertisements to support the App's operation. By using the App, you agree to view advertisements.

Third-Party Advertising

We may display ads from third-party networks. These advertisers may:

• Collect information about your device and usage

• Use cookies and tracking technologies

• Display targeted advertisements

You can manage ad preferences through your device settings. Please review our Privacy Policy for details on advertising data collection.

Disclaimers and Warranties

"AS IS" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability

• Fitness for a particular purpose

• Non-infringement

• Accuracy or reliability of content

• Uninterrupted or error-free operation

• Freedom from viruses or harmful components

No Guarantee

We do not guarantee that:

• The App will meet your requirements

• The App will be available at all times

• Quiz content is accurate or error-free

• Defects will be corrected

• The App is compatible with all devices

User Responsibility

You acknowledge that:

• Use of the App is at your own risk

• You are responsible for any damage to your device

• You should backup your data regularly

• We are not responsible for connectivity issues

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JACOBS ENTERTAINMENT LLC SHALL NOT BE LIABLE FOR:

Direct Damages

Any direct damages arising from your use of or inability to use the App.

Indirect Damages

Any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue

• Loss of data or information

• Loss of business opportunities

• Personal injury or property damage

• Costs of substitute services

Maximum Liability

In no event shall our total liability exceed the amount you paid to us in the past twelve (12) months, or $100 USD, whichever is less.

Exclusions

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Jacobs Entertainment LLC, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App

• Your violation of these Terms

• Your violation of any rights of another party

• Your violation of any applicable laws or regulations

• Content you submit to the App

Third-Party Services and Links

Third-Party Integration

The App may integrate with or link to third-party services (such as social media platforms, payment processors, or analytics providers). These services:

• Have their own terms and privacy policies

• Are not under our control

• May collect information about you

We are not responsible for third-party services, content, or practices.

External Links

The App may contain links to external websites or resources. We:

• Do not endorse linked content

• Are not responsible for external sites

• Do not guarantee accuracy of external content

• Are not liable for damages from accessing external links

Geographic Restrictions

The App is operated from the United States and intended for users in countries where the App is available. We make no representation that the App is appropriate or available in all locations. If you access the App from other locations, you do so at your own risk and are responsible for compliance with local laws.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law principles.

Informal Resolution

Before filing a claim, you agree to contact us at queztionsllc@gmail.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes within 30 days.

Binding Arbitration

If we cannot resolve a dispute informally, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except:

• Small claims court disputes (under $10,000)

• Intellectual property disputes

• Disputes seeking injunctive relief

Arbitration Agreement:

• Arbitration will be conducted in Charlestown, Indiana, or another mutually agreed location

• Each party pays their own costs

• The arbitrator's decision is final and binding

• You waive your right to a jury trial

• You waive your right to participate in class actions

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in class action lawsuits against Jacobs Entertainment LLC.

Exceptions

Either party may seek injunctive or equitable relief in court to protect intellectual property rights or prevent unauthorized use of the App.

Termination

By You

You may terminate your use of the App at any time by:

• Deleting your account through App settings

• Uninstalling the App from your device

• Contacting us at queztionsllc@gmail.com

By Us

We may suspend or terminate your access to the App immediately, without notice, for:

• Violation of these Terms

• Illegal or fraudulent activity

• Suspicious account activity

• Extended periods of inactivity

• Technical or security reasons

• Business or legal considerations

Effect of Termination

Upon termination:

• Your license to use the App ends immediately

• You must stop using the App and delete all copies

• We may delete your account and data

• Provisions that should survive termination remain in effect

• You remain liable for obligations incurred before termination

Note: Coins, virtual items, and purchases are forfeited upon termination and are non-refundable.

Severability

If any provision of these Terms is found to be unenforceable or invalid:

• That provision will be limited or eliminated to the minimum extent necessary

• The remaining provisions will continue in full force and effect

• The unenforceable provision will be reformed to reflect our intent

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jacobs Entertainment LLC regarding the App and supersede all prior agreements, understandings, and communications.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative.

Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this provision is void.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

• Acts of God (natural disasters)

• War, terrorism, or civil unrest

• Government actions or regulations

• Labor disputes or strikes

• Internet or telecommunications failures

• Power outages or equipment failures

Special Provisions

For Apple App Store Users

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Jacobs Entertainment LLC, not Apple

• Apple has no obligation to provide maintenance or support

• Apple is not responsible for the App or content

• Apple is not liable for any claims related to the App

• Apple and its subsidiaries are third-party beneficiaries of these Terms

• You must comply with Apple's App Store Terms of Service

For Google Play Store Users

If you downloaded the App from Google Play, the following additional terms apply:

• These Terms are between you and Jacobs Entertainment LLC, not Google

• Google has no obligation to provide maintenance or support

• Google is not responsible for the App or content

• Google is not liable for any claims related to the App

• You must comply with Google's Play Store Terms of Service

Updates and Maintenance

App Updates

We may release updates to:

• Add new features

• Improve performance

• Fix bugs and security issues

• Update content

You are responsible for:

• Downloading and installing updates

• Maintaining compatible device software

• Ensuring adequate storage space

Failure to update may result in limited functionality or inability to use the App.

Maintenance

We may perform maintenance that temporarily affects App availability. We will:

• Attempt to schedule maintenance during off-peak hours

• Minimize disruption when possible

• Not be liable for maintenance-related downtime

Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the App:

• You grant us unlimited rights to use them

• We are not obligated to compensate you

• We are not obligated to implement them

• We may use them without attribution

• Your feedback is non-confidential

Age Requirements

Minimum Age

You must be at least 13 years old to use the App. Users under 18 should have parental supervision.
